Terms of Service

1. Acceptance of Terms

By accessing or using MCP SMS Server ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including developers, AI agents acting on behalf of users, and automated systems.

2. Description of Service

MCP SMS Server provides access to virtual phone numbers and SMS verification codes via a Model Context Protocol (MCP) API. The Service is intended for legitimate software development, testing, and automation use cases.

3. Permitted Use

You may use the Service to:

Receive SMS verification codes for services you are authorized to access
Build and test applications that require phone verification flows
Automate legitimate account creation and management workflows
Integrate SMS verification into your software pipelines

4. Prohibited Use

Violation of these terms will result in immediate account termination without refund.

You may not use the Service to:

Register accounts for the purpose of spamming, phishing, fraud, or any illegal activity
Circumvent security controls or abuse detection systems on third-party platforms
Create accounts in violation of the terms of service of any third-party platform
Conduct any activity that violates applicable local, national, or international law
Resell or redistribute access to the Service without written permission
Use the Service to harass, harm, or defraud other users or third parties
Attempt to reverse-engineer, scrape, or disrupt the Service infrastructure

5. Account and API Key

Your API key is personal and must not be shared. You are responsible for all activity that occurs under your API key. If you believe your key has been compromised, contact us immediately. We reserve the right to revoke API keys that are used in violation of these terms.

6. Payments and Refunds

The Service operates on a prepaid credit system. Payments are made in cryptocurrency via CryptoBot and are non-refundable, except:

Phone numbers that did not receive an SMS within the provider's active window are automatically refunded to your account balance
In cases of verified Service malfunction caused by our systems, we may issue a credit at our discretion

Minimum top-up is $1 USD. Prices are subject to change based on provider rates. We do not guarantee specific pricing for any service or country.

7. Service Availability

We aim for high availability but do not guarantee uninterrupted access. The Service depends on third-party SMS providers (5sim, SMS-Activate, OnlineSim), and their availability affects ours. We are not liable for provider outages, number unavailability, or delays in SMS delivery.

8. Limitation of Liability

To the maximum extent permitted by law, MCP SMS Server shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or business, arising out of your use of or inability to use the Service.

Our total liability for any claim arising from these terms or your use of the Service shall not exceed the amount you paid us in the 30 days prior to the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that SMS codes will always be delivered successfully, as this depends on third-party providers.

10. Termination

We may suspend or terminate your access at any time for violation of these terms, suspected fraud or abuse, or for any reason with reasonable notice. Account balance remaining at termination due to terms violation is non-refundable.

11. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the Service after changes are posted constitutes acceptance. For material changes, we will notify users via email.

12. Governing Law

These terms are governed by applicable law. Any disputes will be resolved through binding arbitration or, where required by law, in a court of competent jurisdiction.
